Terms of Service

These Terms of Service govern your use of HOMAKASE, a marketplace that connects guests with independent private chefs for at-home dining experiences. By using HOMAKASE, you agree to these Terms.

Marketplace role

HOMAKASE provides technology for discovery, booking, messaging, payment processing, reviews, and marketplace coordination. Chefs are independent service providers and are not employees, agents, or partners of HOMAKASE. Chefs are responsible for providing their dining services, food handling, preparation, equipment, licensing, insurance, and legal compliance.

Accounts

You must provide accurate information and keep your account secure. You are responsible for activity under your account. HOMAKASE may suspend or remove accounts that provide false information, misuse the service, violate these Terms, or create safety, fraud, payment, or legal risk.

Bookings

Guests may request or book private dining experiences through the app. A booking may require chef confirmation. Guests are responsible for providing a safe and accurate dinner location, complete dietary restrictions, and any important access details. Chefs may accept, decline, or cancel bookings according to HOMAKASE policies.

Payments, fees, and payouts

Payments are processed by Stripe. HOMAKASE may collect a platform fee from each booking. Chefs receive payouts through Stripe Connect after applicable platform fees, refunds, credits, chargebacks, penalties, or payment processor fees. HOMAKASE does not guarantee payout timing where delays are caused by Stripe, banks, identity verification, risk review, chargebacks, or incomplete chef onboarding.

Cancellations and refunds

Cancellations and refunds are governed by the Cancellation and Refund Policy. HOMAKASE may update the policy as needed for safety, fraud prevention, payment rules, or marketplace operations.

Messaging and conduct

Guests and chefs must communicate respectfully and honestly. Users may not harass others, threaten others, request off-platform payment, commit fraud, upload unlawful content, or use HOMAKASE for unsafe or illegal activity.

Reviews

Guests may leave reviews after completed bookings. Reviews should be honest and based on actual experiences. HOMAKASE may remove or hide reviews that include private information, hate, threats, spam, fraud, irrelevant content, or policy violations.

Content

Users may upload profile information, menus, photos, videos, messages, reviews, and documents. You are responsible for content you provide and must have the right to use it. You grant HOMAKASE permission to host, display, process, and use that content to operate and promote the service.

Disclaimers

HOMAKASE is provided "as is" and "as available." We do not guarantee that every chef, guest, booking, payment, payout, message, or feature will be error-free, uninterrupted, or available at all times.

Limitation of liability

To the fullest extent permitted by law, HOMAKASE is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from use of the service, chef services, guest conduct, payment delays, cancellations, or third-party services.

Governing law

These Terms are governed by the laws of the State of Colorado, unless another law is required by applicable consumer protection rules.
